These Terms of Service govern your use of this website, your purchase of Vacation Credit packages, and your participation in the Dream Vacay Giveaway ("Sweepstakes").

By accessing this website or purchasing any package, you agree to these Terms, the Official Sweepstakes Rules, and our Privacy Policy. If you do not agree, do not use this website or participate in the Sweepstakes.

1. GENERAL USE OF THIS WEBSITE

2. SWEEPSTAKES PARTICIPATION

Participation in the Dream Vacay Giveaway is voluntary.

NO PURCHASE IS REQUIRED TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Paid Vacation Credit packages are optional digital products that include complimentary bonus entries as a courtesy. These entries are treated the same as all free AMOE entries.

Sponsor may modify, suspend, or cancel the Sweepstakes due to:

Fraud or abuse
Technical issues
Insufficient participation
Legal restrictions
Events beyond Sponsor's control

If the Sweepstakes is canceled under the Minimum Participation Requirement, all paid package purchases will be refunded.

3. ELIGIBILITY

Eligibility requirements are stated in the Official Sweepstakes Rules.

The Sweepstakes is void where prohibited, including Florida, New York, Rhode Island, Alaska, and Hawaii.

You must be at least 18 years old to enter, and at least 25 years old to redeem the prize stay (or be accompanied by a qualifying adult 25+).

4. VACATION CREDIT PACKAGES (Digital Goods)

Vacation Credit packages are digital goods. No physical products will be shipped.

Each package includes:

Promotional Vacation Credits redeemable toward a future booking
Complimentary sweepstakes entries
Vendor discount access (select packages)
Property booking discounts (select packages)

Vacation Credits Terms:

Vacation Credits:

Are applied dollar-for-dollar as payment toward eligible bookings at The Home Reserve properties
Must meet minimum booking value and minimum night requirements (see Official Rules Section 9 for details)
Are non-transferable and have no cash value
Valid only for the purchaser (non-transferable)
May not be combined with other promotional offers unless explicitly stated
Expire if not booked within 90 days of purchase (stay must occur within 12 months)
Do not guarantee the availability of any specific dates or property
Apply only to base rental rates (cleaning fees, taxes, and optional add-ons are separate)

Example: A $300 credit requires a booking with a total value of at least $1,200 for a minimum of 5 consecutive nights. The credit reduces the amount due to $900.

Vacation Credits do not constitute a deposit, reservation, or guaranteed right to book. All bookings are subject to availability.

5. NO REFUNDS

All Vacation Credit package purchases are final and non-refundable, except when the Sweepstakes is canceled under the Minimum Participation clause of the Official Rules.

Digital products cannot be returned, exchanged, or credited.

6. SWEEPSTAKES ENTRIES

Complimentary entries included with paid packages:

Are treated equally with all free entries
Provide no advantage in the drawing
Have no monetary value
Cannot be purchased separately or converted into goods, services, or discounts

Sponsor may void entries deemed fraudulent, duplicated, automated, or submitted in violation of the Official Rules.

7. AMOE (Alternate Method of Entry)

A free method of entry is always available.

Instructions are included in the Official Rules and are accessible without purchase.

AMOE entries receive the same treatment as all other entries.

8. PRIZE CONDITIONS

Winner responsibilities include:

Complying with all prize claim steps
Providing valid identification
Signing prize acceptance and rental agreements
Paying any applicable taxes
Covering any costs exceeding the prize value

The prize stay is subject to:

Property rules and policies
Guest limits (up to 12 guests)
Standard rental terms and conditions
Damage responsibility clauses
Booking availability (no blackout dates, but availability not guaranteed)

Travel credit must be coordinated and booked by Sponsor, may not be self-booked, and carries no cash value.

Winner must book stay within 60 days of notification; stay must occur between March 2026 – March 2027.

9. TECHNICAL & PLATFORM LIMITATIONS

Sponsor is not responsible for:

Technical failures or malfunctions
Delayed, lost, misdirected, or incomplete entries
Email or SMS delivery issues
Shopify or payment processor errors
Internet outages or connectivity issues
Platform downtime or maintenance
Processing delays

Your use of third-party systems (Shopify, Klaviyo, SMS platforms, payment processors) is at your own risk.

10. LIABILITY LIMITATION

TO THE EXTENT PERMITTED BY LAW:

Sponsor's total liability shall not exceed the Approximate Retail Value (ARV) of the prize ($30,000 USD)
Sponsor shall not be liable for incidental, indirect, punitive, or consequential damages
Sponsor is not responsible for vendor availability, service quality, or changes to bonus experiences

By participating, you release Sponsor and its affiliates, officers, directors, employees, and agents from all claims arising from your use of the website, participation in the Sweepstakes, or acceptance of any prize.

11. MOBILE/SMS TERMS

By enrolling in Dream Vacay Giveaway SMS messaging, you agree to:

Receive recurring automated promotional and transactional messages
Standard message and data rates apply (check with your carrier)
Message frequency varies
Consent is not required to purchase or participate in the Sweepstakes

Wireless carriers are not liable for delayed or undelivered messages.

You may not reproduce, distribute, modify, or create derivative works from any content without express written permission from Sponsor.

13. GOVERNING LAW & DISPUTES

These Terms of Service are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of this website shall be resolved exclusively in the state or federal courts located in Sacramento County, California.

14. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. CHANGES TO TERMS

Sponsor may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
